Self-determination law / entry into gender-specific areas Since 01.11.2024, the law on self-determination with regard gender entry (SBGG) has had an impact. According to this, the entry of gender can be changed annually at the registry office, regardless of biological sex. However, this does not lead to a different right of access to gender- specific areas. Only persons whose primary sexual characteristics correspond entitled to enter these areas, in particular the women's sauna. The entry of gender at the registry office and/or in the passport is not decisive. The following guidelines provide orientation on how to proceed... ...at the checkout: • Visual inspection of appearance at the checkout (is the person perceived as male, female or diverse) • In case of doubt, ask and request the submission of the gender entry • If there is still any doubt, the guest must be informed that the primary gender characteristic is decisive for access to the relevant area ...in gender-specific areas (e.g. women's sauna): • If it is only noticed in the sauna facility or if other guests indicate that unauthorized access has occurred, the guest will be expelled from the area and the entrance fee will be refunded with reference to the house rules. The guest may voluntarily provide proof of their primary gender characteristic in order to clear up any misunderstandings. However, they will not be expressly requested to do so by the staff. • If the guest refuses to leave the sauna facility, the pool or sauna management and the legally authorized decision-makers must be informed. The police must be requested to enforce the house rules. • The decision to issue a house ban that extends beyond the day is carried out by a person legally authorized to represent the company.

Selbstbestimmungsgesetz / Eintritt in geschlechtsspezifische Bereiche Seit dem 01.11.2024 wirkt sich das Gesetz über die Selbstbestimmung in Bezug auf den Geschlechtseintrag (SBGG) aus. Danach kann beim Standesamt jährlich der Eintrag des Geschlechts, unabhängig vom biologischen Geschlecht, geändert werden. Dieses führt aber nicht zu einem anderen Zutrittsrecht in geschlechtsspezifische Bereiche. Zum Eintritt in diese, insbesondere auch die Frauensauna, sind nur Personen berechtigt, deren primäre Geschlechtsmerkmale entsprechend sind. Der Eintrag des Geschlechts beim Standesamt und/oder im Reisepass sind nicht entscheidend. Der folgende Leitfaden gibt eine Orientierung zum Vorgehen… …an der Kasse: • Sichtkontrolle des Erscheinungsbildes an der Kasse (wird die Person als männlich, weiblich oder divers wahrgenommen) • Bei Zweifeln Nachfrage und Verlangen der Vorlage des Geschlechtseintrages • Bestehen auch dann noch Zweifel, ist der Gast darauf hinzuweisen, dass für den Zugang zu dem entsprechenden Bereich das primäre Geschlechtsmerkmal ausschlaggebend ist …in geschlechtsspezifischen Bereichen (z. B. Frauensauna): • Sollte erst in der Saunaanlage auffallen bzw. ein Hinweis von anderen Gästen erfolgen, dass ein unberechtigter Zutritt geschehen ist, erfolgt unter Bezugnahme auf das Hausrecht ein Verweis des Gastes aus dem Bereich sowie ein Erstatten des Eintrittsentgeltes. Der Gast kann freiwillig sein primäres Geschlechtsmerkmal nachweisen, um Missverständnisse auszuräumen. Dazu wird er aber vom Personal nicht ausdrücklich aufgefordert. • Sollte sich der Gast weigern, die Saunaanlage zu verlassen, sind Bad- bzw. Saunaleitung und die rechtlich vertretungsberechtigten Entscheidungsträger zu informieren. Die Polizei ist zwecks Durchsetzens des Hausrechts anzufordern. • Die Entscheidung über das Erteilen eines über den Tag hinausgehenden Hausverbotes erfolgt durch eine rechtlich vertretungsberechtigte Person.
