The NSW Net Zero Commission recently advised the NSW Government that export emissions and local climate harms must be considered in proposed coal expansions.
The science and the law is clear - business as usual is no longer an option.
The case follows recent Court of Appeal decision, Denman v MACH Energy, where the court found a direct causal link between export emissions from coal, and local climate harms.
It also comes after the International Court of Justice confirmed countries will be liable for transboundary climate harms.
Principal Lawyer Anita O'Hart said:
βLocal communities in NSW are suffering from the impacts of extreme bushfires, floods and heatwaves.
βConsideration of those harms is a mandatory consideration for future fossil fuel projects, including for modifications and applications already in the system.β
More big news today as the Land and Environment Court makes orders, by consent, overturning approval of Glencoreβs Ulan Coal Mine expansion.
