Instead, its a repeat of the thinking from 2011: move things into elections and the courts, which has failed labor repeatedly for more than a decade. 6/6

Pursuing a stay and a legal decision is the wrong move. They have the opportunity to press the demand to bargain at municipalities, county services, and school boards now and get workers into motion. It would positively change the balance of forces for when the case is eventually heard. 5/6

The thinking of AFT, NEA, SEIU, AFSCME and the other plaintiffs is that they want to get this to the Supreme Court as quickly as possible while there is a (slight) liberal majority. That, and it will motivate GOTV in the Spring for yet another Supreme Court seat election. 4/6

The coalition of unions who brought the suit are already negotiating with the Legislature to have a stay on the decision pending a decision by the Wisconsin Supreme Court - meaning that it would not go into effect until a decision is made by there. No bargaining if that happens. 3/6

The ruling effectively restores the right for certified unions to bargain. Republicans in control of the Legislature announced they will challenge the ruling, as they have done the previous times the law was struck down in lower courts. 2/6

Yoon is notoriously anti-union and has tried to impose a more authoritarian regime since he came to power in 2022 (with a 0.8% margin by the way).
