Gotta say it sounds like the teams are right. If you can’t sway a mediator who presumably has a somewhat favorable view of a sports association’s point of view (given his past employment history), things aren’t looking good for nascar.

From Pockrass, it sounded like they’d already been meeting with a mediator. I’m guessing nascar didn’t like the direction the mediator was taking things and hope they’d get a better reception from a judge. Either way, sounds like you’re right — they are getting pretty nervous.

So a fellow sports federation attorney isn’t helping the auto racing federation feel comfortable with their position, huh?

But I thought winning was all that mattered? 🤷‍♂️

Maybe. But it sounded like Bubba’s tires were gone and not sure he could have held on. Even for that list stop, Bubba was asked whether he wanted to try & hang on and risk bleeding spots or pit & hope for a caution; Bubba wanted to pit.

So both parties missed the judge’s memo: “Quit filing for summary judgment! This thing is going to trial unless y’all settle. (Y’all best settle!)”
