I can imagine it being too late once he found them, so his ethical failure was in not negotiating access to the land in a way that ruled sale out - and if the land owner declined to agree on such terms, walking away? The (professional) obligations do feel more on him than the land owner.

Presumably the argument would be it was unethical to make an agreement which did not require the landowner to exclude the right to sell anything found?
