The Farmer Plaintiffs have entered into contracts with installers, purchased supplies, expended significant funds of their own and, in some cases, taken on loans to pay their portion of the projects. Much of this money will be unrecoverable if the government does not resume disbursing reimbursement payments. Plaintiffs Butterbee Farm and One Acre Farm, who have fully completed solar projects, will have to pay tens of thousands of dollars that the government had promised to pay pursuant to the terms of their REAP grants for the already completed installations. Such a substantial, unexpected financial burden could put Plaintiffs’ farms’ financial futures at risk.
