Reproductive health group, ACLU sue Trump administration over Title X funding One of the countryโ€™s largest reproductive health advocacy groups is suing the Trump administration for withholding millions of dollars in federal family planning grants earlier this year. The National Family Planning and Reproductive Health Association (NFPRHA) and the American Civil Liberties Union (ACLU) filed a lawsuit in the U.S. District Court for the District of Columbia on Thursday, claiming the Department of Health and Human Services (HHS) โ€œunlawfully withheldโ€ $65.8 million in Title X funds to 16 family planning groups. Title X is the nationโ€™s only federally funded family planning program providing birth control and reproductive health care to low-income Americans. More than a dozen family planning organizations, including nine Planned Parenthood affiliates, received letters in late March stating the Trump administration planned to โ€œtemporarily withholdโ€ their allotted Title X grant funding. The administration restored millions in funding a few days later, but those dollars went to Oklahoma and Tennessee state health departments, which had been barred from receiving Title X funds during the Biden administration for violating some of the programโ€™s rules. โ€œThe consequences of withholding funding are devastating,โ€ said Clare Coleman, president and CEO of NFPRHA. โ€œThe loss of Title X means hundreds of thousands of patients are at risk of losing access to critical health care.โ€ Since the funds were frozen, more than 860 family planning service sites across 22 states have been unable to provide โ€œcritical health careโ€ such as contraception, cancer screenings and testing and treatment for sexually transmitted infections, according to the lawsuit. At least seven states โ€” California, Hawaii, Maine, Mississippi, Missouri, Montana and Utah โ€” no longer have any Title X-funded family planning services, the lawsuit adds. The plaintiffs are asking the court to force HHS to dispense Title X to the 16 groups that have had their grant money withheld and pay the NFPRHA and the ACLUโ€™s legal fees associated with filing the lawsuit. They argue that by withholding the funds, the Trump administration violated the Administrative Procedure Act, an almost 80-year-old federal law that governs the process that federal agencies use to craft and implement new regulations. They also argue HHS acted โ€œarbitrarily and capriciouslyโ€ when deciding to withhold Title X funds for the 16 family planning groups since it did not provide a โ€œreasonable explanation or justificationโ€ for its actions. Plaintiffs argue that the agency targeted those particular family planning groups for making public statements supporting diversity, equity and inclusion and opposing racism, according to a press release from NFPRHA. HHS has not responded to a request for comment about the lawsuit from The Hill. โ€œWithholding Title X funding for critical reproductive health care is the latest Trump administration attack on our communities,โ€ said Brigitte Amiri, deputy director of the Reproductive Freedom Project at the ACLU. โ€œIn its zeal to take away reproductive health care from the marginalized communities, the federal government violated its own laws, and it must be held accountable.โ€ Copyright 2025 Nexstar Media Inc. Why it matters: To Democrats, the arrest marks a significant escalation in President Trump's efforts to consolidate power and use federal law enforcement to crush legal obstacles to his agenda. "It is remarkable that the Administration would dare to start arresting state court judges," said House Judiciary Committee ranking member Jamie Raskin (D-Md.). "It's a whole new descent into government chaos." "The Trump administration again is breaking norms in how it's dealing with immigration, the legal system, and normalcy. ... This is stuff I expect from Third World countries," Rep. Mark Pocan (D-Wisc.) told Axios. Said Rep. Greg Landsman (D-Ohio): "They arrested a judge?! They can no longer claim to be a party of law and order. This will have to be a red line for congressional Republicans. Unbelievable." What happened: Dugan was arrested Friday morning at the Milwaukee County Courthouse on charges of obstruction and concealing an individual, a spokesperson for the U.S. Marshals Service told the Milwaukee Journal Sentinel. The Milwaukee County Circuit judge is in federal custody and was scheduled to appear before a U.S. magistrate later Friday. A source familiar with the matter, speaking on the condition of anonymity, confirmed the arrest to Axios. FBI Director Kash Patel, in a now-deleted post on X, accused Dugan of "intentionally misdirect[ing]" ICE agents who were attempting to arrest Eduardo Flores Ruiz, an undocumented defendant in her courtroom. The other side: Rep. Derrick Van Orden (R-Wisc.) told Axios, "It is abundantly clear that many activist judges around the country have been acting politically in order to sabotage President Trump's agenda, and disenfranchise the 77 million Americans that voted for him." "Judges are not supposed to write the law, and they certainly are not above it," he added. Rep. Troy Nehls (R-Texas), a staunch Trump ally, told Axios he, too, supports the arrest, exclaiming, "Lock em up!!" Said Rep. Tim Burchett (R-Tenn.): "If she broke the law, she needs to be prosecuted to the fullest extent. No double standards." What to watch: Democrats are already calling for an investigation into the arrest and the facts surrounding it. "If ICE is allowed to be above the law, then clearly they need to have their operation looked at closely," said Pocan. Rep. Becca Balint (D-Vt.), a House Judiciary Committee member, said there should "absolutely" be a probe: "On the face of it, this is dangerous and outrageous and it is designed to intimidate our judiciary."
