Nearly 300 people have been killed in that time.
Donโt tell me that what happens via emergency applications โ regularly called the shadow docket for nearly a decade โ is an โinterim docket.โ
I will tell the attorneys that their concerns about their clients having been killed โ including one person on Thursday โ should be kept in context because those denials of a stay of execution were, after all, just orders on the interim docket.

I truly donโt understand how you just accede to Kavanaughโs self-serving make-believe name for the shadow docket.
Itโs not the interim docket.
A thread from me, someone who has been covering emergency applications since before Will Baude called it the shadow docket in a 2015 law review article.
