I’m also not a fan of the term “interim docket.” We shouldn’t forget that this is the same docket on which death-row individuals are denied late-stage relief from execution. Nothing interim about that.

I’ve been covering execution-related litigation up to the Supreme Court for more than a decade.

Nearly 300 people have been killed in that time.

Don’t tell me that what happens via emergency applications — regularly called the shadow docket for nearly a decade — is an “interim docket.”

I will tell the attorneys that their concerns about their clients having been killed — including one person on Thursday — should be kept in context because those denials of a stay of execution were, after all, just orders on the interim docket.

I will inform each researcher and scientist whose NIH grants were cut know that their concerns are overblown; it is just an interim order.

I will be sure to let everyone targeted by a Kavanaugh stop know that they need not fret, it was only an interim order.

I will let every trans person kicked out of the military know they needn’t worry because it is just an interim order.

I had missed the SCOTUSblog post about the “interim docket blog”; wanted to scream but it’s late; texted @jaywillis.net instead; & he let me know that, oh, yes, this has been discussed.

I truly don’t understand how you just accede to Kavanaugh’s self-serving make-believe name for the shadow docket.

It’s not the interim docket.
