2024 appears to be an outlier, and if you discount that we can see that the trend is now generally down again reflecting the effect of reforms in An Coimisiรบn Pleanรกla and developments in case law

This tallies with my data, and is why I publish it. The rise in litigation around 2020 was due to the defunct SHD process and to a lesser extent the Heather Hill High Court judgment in 2019 (notably the 2022 Supreme Court ruling was not followed by an increase)

So it seems the claim of 30% increase in judicial review in 2025 was based on the number to 26 June & *a guess* at a number for July to Dec (which wasnโ€™t fact checked & is wrong)

Even those numbers are bogus since the "resolved by court" column includes formal orders where cases have been conceded or withdrawn, i.e. ones that manifestly resolved by court, unless that phrase is given a totally different meaning to what you and I understand it to mean

If I had failed a responsibility to deliver housing and infrastructure for decades, I too might try to build a narrative blaming my failure on third parties (courts, lawyers, citizens, The Goblin Prince Under The Mountain).

If those proposals on capping legal costs for planning JRs go through (they wonโ€™t) we will need a dozen extra judges to cope with all the lay litigation that will spring up as a result

Believe me when I say that NOBODY benefits from that
