The precedent this sets is terrifying. It creates a playbook for authoritarianism:
* Defy any court order you don't like.
* Claim emergency powers.
* Count on a captured SCOTUS majority to bail you out with an unsigned, unexplained order.
Justice Sotomayor's dissent is absolutely blistering. She accuses the government of "flagrantly unlawful conduct" and the majority of a "gross abuse" of power.
Her money quote: The Court apparently finds "violence in farflung locales more palatable than" inconveniencing the executive branch.
The case is D.V.D. v. DHS. The administration was caught repeatedly defying federal court injunctions, deporting people to active conflict zones like South Sudan & Libya, sometimes with less than 24 hours' notice, while their cases were still active.

In a 6-3 unsigned order, the majority rewarded the executive branch for openly defying lower court orders. It's a case of democratic backsliding in plain sight. #SCOTUS #ConLaw
