*foreign spies stealing gov’t and trade secrets
*foreign and domestic terrorist threats
*crimes like fraud, corruption, trafficking, and violent crimes (among others)

2/2 Back at the dawn of the online research, West had a stranglehold on bound case reporter books. They claimed content of the case law couldn't be used because their books were the ones that we used in the library. But they didn't own content of judicial opinions just because they published them.

Nobody wants to follow WL/Lexis. But the cases re their attempt to enforce copyrights of compiled non-copyright materials were very important and limited their rights to what they added. Their ridiculous positions were comparable to AI's theft & republishing of art, books & website content now. 1/2

Westlaw and Lexis charge for their databases because they add content that (some) consider useful.

However, low cost legal libraries are able to make available to the public free or near-free non-copyrighted content while omitting the copyrighted summaries/headnotes.

Nonlegal libaries do the same.

Yes and no. If an AI company settles, it would likely contain a ban worldwide unless $x per use license fee.

Most likely outcome is companies shut down a la Napster bc fees for use are prohibitive to profit. Good riddance.

Actually, no. It depends on what is in the data set and where that information comes from.

The legal industry has dealt with this issue over case law citations for decades, since Lexis & Westlaw were battling out what they own.

Neither owns case law text or citations. Only commentary & headnotes.

The Rome Statute for the ICC was never ratified by the Senate after signed by Clinton in 2000.

W advised the UN Sec General on 5/6/2002 that US would not ratify. Thus US has no obligation even as signatory to uphold the general purposes of the ICC.

We suck. Ugh.
