What does this mean?
The High Court’s judgment remains in force, binding, and must be complied with in full unless and until the Court orders otherwise.
Following that judgment, the State filed an application before the Court of Appeal seeking a stay of the decision.
After a hearing on the application, the Court of Appeal has declined to grant an interim stay pending its ruling, scheduled for 24 April 2026.
The Court reaffirmed that executive power must be exercised strictly in accordance with the Constitution and the Public Service Commission framework, and in line with the values of transparency, merit, fiscal responsibility, and public participation.

Advisors’ Judgment Remains in Force After Court Declines Interim Stay:
Last month, the High Court allowed our petition and declared the creation and staffing of the Offices of Advisors to the President unconstitutional.

The Court also found that the Kenya Tea Development Agency Holdings Ltd (KTDA), the Tea Board of Kenya, and the Independent Electoral and Boundaries Commission (IEBC) failed in their duty by clearing him without proper due diligence.
Katiba Institute was the sixth interested party.
The petition arose from a February 2023 BBC documentary in which women accused Chebochok of sexual harassment and exploitation in exchange for employment. Despite public allegations, he was cleared to contest for the position of director at Tegat/Toror Tea Factory in Ainamoi Zone.

The High Court at Kericho declared John Chebochok unfit to hold any public office in Kenya, finding that he violated constitutional provisions on national values and governance, equality and non-discrimination, human dignity, and leadership and integrity.

Access to Information compliance in Nakuru:
Katiba Institute, in partnership with Midrift Hurinet, Commission on Administrative Justice (Ombudsman), and the County Government of Nakuru, today hosted a training on Access to Information (ATI) Compliance for Nakuru County officials and community reps.
In its ruling, the Court agreed with our submissions, as advanced by our litigation counsel Joshua Malidzo Nyawa, that it could not re-open a matter it had already considered and dismissed.
This follows the High Court’s ruling that presidential advisors’ offices are unconstitutional.
