I said my main goal of this trip was to meet with Kilmar. Tonight I had that chance. I have called his wife, Jennifer, to pass along his message of love. I look forward to providing a full update upon my return.

I, for one, welcome the β€œabundance” fight. It shows the left can fight Trumpism while wrestling with how we can be better than we’ve been.

I have no interest in β€œactually the government has been doing great” liberalism.

When in reality, H1Bs serve a purpose - for example, filling teacher shortages in rural counties as is the case for my parents who are public school teachers. So a real fix to the H1B challenge would be to (1) slowly lift the cap for green card allotments and…

I think many firms do act in good faith, but I think my problem with this whole discussion is that Elon, Bernie, et al are focusing on the wrong thing regarding H1Bs (the availability of the visa itself.

Oh wholeheartedly agree with that! I’m Indian, and I hate it - HATE it - when some Indians compare H1B to slavery. It’s an injustice but not that, and language like the ones we have used in the past alienates people and makes us seem dramatic and out of touch. Trust me, agree with you on this one!

And finally, petitions approved for initial employment is significantly lower (Table 9a-10b, pg 50-56)

02.01.2025 23:48 β€” πŸ‘ 2    πŸ” 0    πŸ’¬ 0    πŸ“Œ 0

This is important because many smaller private firms sometimes keep H1B workers for a short time period and fire them after project completion. I have anecdotal data on this but I would think actual data on this would be hard to report.

Additionally, page 15 (including the footnote 15) mentions that the wages reported on figure 10 are those that are reported at the time of the initial offer and β€œnot verified after hiring”.

I don’t see a mention of $60K minimum on page 15. I may have missed it. Could you please point out what you’re referring to? A screenshot would be helpful.

My friend, H1B visas do not make a distinction in whether you’re working for a for-profit company (Amazon) or a public school. Trust me, I wish they did. It’d make the my life and the lives of my parents a lot easier.

Now this is only transferring jobs from non-cap exempt employer to another non-cap exempt employer. And like I said, cap exempt employers are hard to find.

02.01.2025 23:35 β€” πŸ‘ 2    πŸ” 0    πŸ’¬ 1    πŸ“Œ 0

Prevailing wage determination alone takes 90 days, and if there is a 60 day + gap between ending your employment with employer A and finding a new job at employer B, then you have to leave the country. There both direct and indirect costs related to this on the applicant’s end.

Changing Employers While Holding H-1B Status Once an H-1B worker is in the U.S., s/he may decide to change employers. This is sometimes referred to as a "transfer" or "sequential employment." ...

Even then, the reality is that transferring your H1B to a new employer is super complex and requires additional cost on both the applicant’s end (filing fee) and new employer’s end (eg, PW determination).

Fact Sheet #66E: The Davis-Bacon and Related Acts – Compliance with Fringe Benefit Requirements Wage and Hour Division Fact Sheet - U.S. Department of Labor

Huh? Prevailing wage? Bud, prevailing wages only apply for workers who are working on federally funding contracts. Vast majority of H1B workers are on privately funded projects (e.g., Amazon or Google). Priv companies should pay wrkrs a competitive wage but many don’t.

Sure but employers who are cap exempt are very rare. And even if you find an employer with cap exemption status, those jobs are pretty hard to get.

How do I know this? I am a product of this system. My parents (teachers on a H1B) have been waiting for their green cards since *checks notes* 2010 with no end in sight. 14 years sure sounds like a lot closer to forever.
