She explains that the original document was marked as though the grand jury had returned a no bill on the entire indictment, not just Count 1. Post 2: She says this confused the magistrate because there appeared to be a discrepancy between the two documents submitted by the foreperson. The magistrate had the foreperson pencil in an amendment to clarify that the no bill applied only to Count 1. Post 3: She states that the amended original indictment is not the operative charging document. The operative indictment is the second one, which the grand jury did not vote on. She adds that the amendment to the original indictment was not made in the presence of the grand jury. Post 4: She reports that the judge asked how many grand jurors were present when the second indictment was handed up (and when the amendment was made).
