There are legal methods to anticipate on a down trend market, e.g. put options or futures. But all are only allowed if you did not have insider info on timing and impact. With insider info it is always illegal, at least it was in the modern world. Not sure how it was in y1929.

Could well be, yeah. Shortselling ist "better" if you know what is coming. It is not for the average investor, and insider info is not (allowed) to be used, in the ideal world.
