International law does contain specific definitions of what constitutes an international armed conflict or a non-international armed conflict. This is a good thing, because rules around what States can do are more permissive when there's an actual conflict.

On subject matter jurisdiction, we'd then get into "is this really an armed conflict?" and if not, "are these acts widespread/systematic?"

It would depend on where the boats are registered! Venezuela's a party to the Rome Statute, so I would think yes, at least the territorial basis for ICC jurisdiction would be satisfied if that's where they're registered.

The rule of law means that civilians who commit crimes are prosecuted in courts of law with benefit of due process. Extrajudicial executions in international waters are an affront to our Constitution and the law of nations. It isn’t national defense. It’s murder.

- If it can happen at sea, it can happen anywhere

- Trump has offered no definition or limiting principle for who can be labeled a "terrorist" and summarily killed

- And no plausible legal theory for why an armed conflict exists
