How an agency can use BA is spelled out in law in purpose statements (in authorizing law, Approps law). In general, an agency can’t use BA for a purpose it wasn’t intended. How narrowly or broadly that β€œpurpose” is written, however, can vary.

The Senate Parliamentarian provides guidance to the Presiding Officer on the interpretation and application of the Senate’s rules, The P/O makes the decision, not the Parl. Accounts are just buckets that hold water (BA), and that water can come from the hot faucet (discretionary BA appropriated by Acts of Appropriation from the House/Senate Approps Cmtes) or the cold faucet (mandatory BA provided by all other legislation, including reconciliation bills ) #8/8

Until the IRA, folks were unaccustomed to the direct appropriation of BA in reconciliation bills for accounts traditionally funded through the annual discretionary spending process. But as long as the provision is germane and complies with the Byrd rule, there are no prohibitions. #7/8

Not a dumb question. Lawmakers ask too. Federal accounts can receive both discretionary & mandatory budget authority (like a bucket that can hold both hot and cold water). The bill that appropriates the BA is what determines the characterization of BA as either discretionary or mandatory. #1/8

As a parent of a UVA alum, I watched firsthand as Ryan steered the school through COVID and other crises, while raising gobs of money for the school. Ryan bleeds orange and blue. My Hoo benefitted enormously from the diversity of her classmates in thought, race, creed, & color. This WILL backfire.
