I glanced at the BIO and if it's right (which it should be since it's from the California OSG) then I agree. An administrative order by the chief judge and two cases on *other* provisions is not a circuit split.

Yeah I think they just didn't buy that any court has actually come out the other way and I'm sure they're fine with the status quo (basically all COAs holding that prisoners can't pool funds)
