Did this interview while researching my forthcoming book on criminal defense. Sharing it now b/c I found these guys inspiring. And we could use some inspiration.

It is ultimately up to the courts to decide what is constitutional, and they sure have made some terrible and atrocious rulings at times that I would consider to absolutely be unconstitutional. But my opinion has no legal weight, only a judge has that power.

Except, that's exactly how the system works.

Maybe the judge is wrong, maybe not, but the judicial system checks the executive and there is an appeals process. It might very well be the valid opinion of someone that a court has ruled in an unconstitutional manner, but that is within their power.
