5 February 2026 Dear Esteemed Members of the Committee, I am the Executive Director of Library Futures, a project of NYU Lawβs Engelberg Center on Innovation Law & Policy. Overdrive CEO Steve Potashβs recent testimony regarding B26-0490: Library E-book Pricing Fairness Amendment Act of 2025 contained a number of factual inaccuraciesabout Library Futures, including: (1) our role in advocating for the bill, (2) our organizationβs mission, and (3) the bill's relationship to the practice of Controlled Digital Lending (CDL). I would like to take this opportunity to provide the Committee with more information about our organization, the work we do, and the importance of B26-0490.
Steve Potash made... a number of misstatements in his 58 pages of testimony on D.C.'s ebook bill, including some about Library Futures. Our ED @littlewow.online corrects them, and @wordsandmoney.bsky.social has a write up.

How does Section 230 affect libraries? Former Library Futures student fellow provided a still-useful rundown in 2023.
www.libraryfutures.net/post/section...
"What [Section 230] does is create breathing room for platforms to moderate content without facing endless litigation over every removal decision, while simultaneously protecting their ability to leave up controversial-but-legal speech without being treated as the publisher of that content."

Love data? It's not quite time for the official Week, but For the People has some nice data viz pulled from last year's IMLS stats.

But as we celebrate culture and digital preservation, let's also remember the many ways that digital media has made that culture LESS accessible to libraries and the people they serve. /3

THANKFULLY, libraries still exist, along with a cool service called interlibrary loan, which means your library can borrow something from another library for you--at least as long as it's not digital (and not a Gutenberg Bible, to be fair). /2
