They can list/unlist whenever they want. They just got to provide reasoning as to why, and pretty much everytime the reasoning is BS. Biden was most likely convinced by Bob Menendez to not unlist. Since Bob is sentenced to 15 years in prison for corruption, Biden was able to unlist.
