These rulings send a clear message: States MUST regulate corporate emissions, including fossil fuel subsidies and licensing, or risk breaching international law.
We now have stronger tools to push for climate justice and to hold governments and companies to account.

This follows the Inter-American Court of Human Rights' powerful ruling earlier this year.
It recognised the right to a healthy climate as an autonomous human right and called on states to adopt legislation to tackle the climate crisis, including the role of companies in driving it.

In a landmark move last week, the International Court of Justice (ICJ) affirmed what frontline communities have long been demanding:

Now, theyโre suing the Dutch government for shutting down the Groningen gas field.
Let's say a government shut down a harmful gas field.
With ISDS, the companies that have invested in this gas field can legally claim compensation for their lost profits - not in public courts, but in secret arbitration.
That's what Shell and ExxonMobil are doing in the Netherlands right now โ ๏ธ
Investor-State Dispute Settlement lets companies run away from the harm they cause and blocks a just fossil fuels phase-out. โ๏ธ
It allows foreign investors to sue governments when their actions are alleged to harm their investment.
