I feel like this photo of masked, armed men pepper spraying a pastor protecting his community is going to be a defining picture of this moment in America for a long, long time.

Let's say it again:

1) Harvard said "No," and Trump has backed off.

2) Chicago (and Illinois) said "No," and Trump has backed off.

It's day by day. But those who said "OK, sure," have gained nothing at all. Except shame.

Key phrase here is "and only us"

This was the core of Dred Scott, that the founders meant the word citizen to only mean white settlers.

And 14th Amendment birthright citizenship clause was an explicit repudiation of that, that all born here have an equal claim on what it means to be an American

There's that part in 1231 where they get to decide to ignore a designation if they determine it prejudices the United States, which they would undoubtedly say because they're sociopaths.

FBI shows up at Charlottesville public defender's home unannounced after ICE raid The day before the Memorial Day weekend, FBI agents arrived at the homes of Charlottesville-area lawyers to question them about an ICE raid in the city in April.

FBI agents are now visiting Charlottesville’s public defenders *at their homes*. It’s naked intimidation of our justice system.

The Supreme Court denied cert today in a complicated and controversial case involving federal Indian law, Apache Stronghold. This case, brought by a nonprofit and not a Native nation, focused closely on the Religious Freedom Restoration Act (rights) over the treaty violations (power).

Creating a Common Law of Slavery for England and its New World Empire | Law and History Review | Cambridge Core Creating a Common Law of Slavery for England and its New World Empire - Volume 39 Issue 4

The law professors who are arguing against birthright citizenship in the US are reinventing a common law decision from 1677 about allegiance and aliens that was pivotal for creating a common law of slavery in England’s empire.
β€” a logic recreated in Dred Scot.
β€” rejected by 14th amendment.

Something to keep your eye on after the birthright citizenship arguments: 2 other cases before SCOTUS- 1 involving humanitarian parole & another involving TPS- where the govt is asking SCOTUS to let it deport up to 1 million people w/o going through the proper legal process. 🧡

6. After the Latham & Watkins team identified the source as potential additional
support for Ms. Chen’s testimony, I asked Claude.ai to provide a properly formatted legal
citation for that source using the link to the correct article. Unfortunately, although providing the
correct publication title, publication year, and link to the provided source, the returned citation
included an inaccurate title and incorrect authors. Our manual citation check did not catch that
error. Our citation check also missed additional wording errors introduced in the citations during
the formatting process using Claude.ai. These wording errors are: (1) that the correct title of the
source in footnote 2 of Ms. Chen’s declaration is Computing Necessary Sample Size, not, as
listed in footnote 2, Sample Size Estimation, and (2) the author/preparer of the third source cited
in footnote 3 is β€œWindward Environmental LLC”, not β€œLower Windward Environmental LLC.”
Again, we apologize for these citation errors.

Oh, sweet merciful fire, two notes:

(1) Even Latham & Watkins, ya'll.

(2) The lawyer defending an AI company for using stolen IP to train their AI/LLM used the company's AI/LLM to cite check her brief, which hallucinated results.

If you can no longer demonstrate citizenship through a birth certificate, this impacts *all* children born in the United States, not just ones covered by the birthright citizenship EO as I outline here

Another Reason Trump’s Birthright Citizenship Order is Unlawful Authors discuss the birthright citizenship statute and who Congress in the 1940s and 1950s intended to cover.

Another Reason Trump’s #BirthrightCitizenship Order is Unlawful

By Professors Kristin A. Collins, Gerald Neuman and @rosenbloom.bsky.social

"The EO is unlawful for another reason that has received far less public attention: it violates the federal birthright citizenship statute."
