In other words, the federal government is different from a business and different than your family budget. It has a sovereign currency and can and does use deficit spending when that's appropriate.

So the trust fund for Medicare Part A being "exhausted" does not necessarily mean that Part A benefits must be cut. The government could temporarily pay benefits from general revenue, either as deficit spending or by cutting other expenses. Like how a trust fund surplus is used to pay general costs.

It's important to remember that the concepts of "exhausting" and "insolvency" are misleading when used about federal trust funds for Medicare, Social Security, etc. These trust funds could go into a deficit position. The question would be what fiscal/monetary policy is needed to avoid inflation, ...

It seems to me that Trump will prevail in a challenge of this Section 122 tariff. But luckily it will last only 150 days since Democrats in the Senate (enough of them) will not likely go along with extending it.

I believe the DOJ argument was that Trump had not *asserted* a balance-of-payment issue or invoked Section 122. I don't see how that argument has relevance now. It should hinge on courts reviewing the BOP facts, unaffected by a legal argument that said nothing either way about those BOP facts.

I'm not trying to add snark. I keep hearing versions of this and think it's useful to consider.

Let's assume for the sake of argument that it is true that the lower courts are working. That forcing lawyers for immigrants to prove 4,400 times that the .gov breaking the law is the system working. +

The events described in this video occurred in the past, before the classified documents case against Trump was dismissed. Trump cannot be prosecuted while in office and the statute of limitations will run out before the end of his term.

Even with a habeas petition and a court order for a person detained unlawfully to be released, they *still* attempt to bully him into accepting removal while denying access to his attorneys. This is the better case where the person has legal representation. Imagine how the unrepresented are treated.

And SCOTUS had to know that this would be the game when they eliminated the nationwide injunction. Sure, you can litigate every case individually. Or can you? How do all these people manage to litigate their cases? Answer: they don't.

Their real game, IMO, is revealed in that, as Chris says, there are thousands of arrests and hundreds of habeas cases. They are getting away with unlawful arrest and removal for the vast majority of the people seized. Only a fraction get representation and make it to court with a habeas claim.
