In other words, the federal government is different from a business and different than your family budget. It has a sovereign currency and can and does use deficit spending when that's appropriate.

So the trust fund for Medicare Part A being "exhausted" does not necessarily mean that Part A benefits must be cut. The government could temporarily pay benefits from general revenue, either as deficit spending or by cutting other expenses. Like how a trust fund surplus is used to pay general costs.

It's important to remember that the concepts of "exhausting" and "insolvency" are misleading when used about federal trust funds for Medicare, Social Security, etc. These trust funds could go into a deficit position. The question would be what fiscal/monetary policy is needed to avoid inflation, ...

It seems to me that Trump will prevail in a challenge of this Section 122 tariff. But luckily it will last only 150 days since Democrats in the Senate (enough of them) will not likely go along with extending it.

I believe the DOJ argument was that Trump had not *asserted* a balance-of-payment issue or invoked Section 122. I don't see how that argument has relevance now. It should hinge on courts reviewing the BOP facts, unaffected by a legal argument that said nothing either way about those BOP facts.

Similarly, they are not opposition, they are “opposition”. Example: “negotiating” weak reforms of ICE instead of abolishing it. (Body cameras, come on now.)

Agreed except it needs scare quotes. They are not consultants, they are “consultants”. Consulting is not being purchased. It’s just a ruse for shoveling money to themselves and their family and friends. Example: Hunter Biden.

Actually he’s a liar and criminally corrupt — that’s why he made the ridiculous claims. The tariffs are clearly a mechanism for extortion and market manipulation for his own enrichment. Whether he believes his own outrageous claims doesn’t really matter.

Isn’t it simpler than that? If and only if federal agents commit a crime under state law then local law enforcement can charge and arrest them. Supremacy clause doesn’t change it one way or another, does it? (Actually asking.)

I do believe it's important to post these videos, but it should be made clear that it's an explanation from the past and its statements about the ramifications are now obsolete.

The events described in this video occurred in the past, before the classified documents case against Trump was dismissed. Trump cannot be prosecuted while in office and the statute of limitations will run out before the end of his term.

He was subject to physical danger, both through reckless driving of ICE agents transporting him from one location to another, watching people screaming in pain with medical neglect, being exposed to COVID. Just the conditions of his confinement; eating food that he conflated with dog food. That people are just being treated like less than human. And all of this was happening while he had a court order for his release. And while all of this is happening, ICE agents are telling him to self-deport because he's got no chance to get out of there other than self-deport, so he's being deprived of access, and this is all in his affidavit. Myself and his immigration attorney, who's here in the courtroom today, were not able to talk to him. His immigration attorney in particular made diligent efforts to ensure compliance with the court order, and these are e-mails that are in Oscar's case. I think you've seen these. We're trying to get ahold of him. We're trying to get access to him. We're trying to bring him home. And, meanwhile, he is sleeping on the floor, if he gets to sleep at all, and he's being lied to, denied access to phone calls to call his loved ones or his attorneys. I would encourage Your Honor to read this declaration, and I would defer to the Court if you would like me to submit it formally in Oscar's own case.

Even with a habeas petition and a court order for a person detained unlawfully to be released, they *still* attempt to bully him into accepting removal while denying access to his attorneys. This is the better case where the person has legal representation. Imagine how the unrepresented are treated.

And apparently that is a feature, not a bug. It's by design.

And SCOTUS had to know that this would be the game when they eliminated the nationwide injunction. Sure, you can litigate every case individually. Or can you? How do all these people manage to litigate their cases? Answer: they don't.

Their real game, IMO, is revealed in that, as Chris says, there are thousands of arrests and hundreds of habeas cases. They are getting away with unlawful arrest and removal for the vast majority of the people seized. Only a fraction get representation and make it to court with a habeas claim.
