WASHINGTON โ€“ Senate Intelligence Committee Vice Chairman Mark R. Warner (D-VA) issued the following statement blasting the Trump administration for holding a partisan military briefing and withholding legally requested information from Democratic senators:

โ€œShutting Democrats out of a briefing on U.S. military strikes and withholding the legal justification for those strikes from half the Senate is indefensible and dangerous. Decisions about the use of American military force are not campaign strategy sessions, and they are not the private property of one political party. For any administration to treat them that way erodes our national security and flies in the face of Congressโ€™ constitutional obligation to oversee matters of war and peace.

โ€œThis partisan stunt is a slap in the face to Congressโ€™ war powers responsibilities and to the men and women who serve this country. It also sets a reckless and deeply troubling precedent. The administration must immediately provide to Democrats the same briefing and the OLC opinion justifying these strikes, as Secretary Rubio personally promised me that he would in a face-to-face meeting on Capitol Hill just last week. Americans deserve a government that fulfills its constitutional duties and treats decisions about the use of military force with the seriousness they demand.โ€

This is OUTRAGEOUS. The administration finally briefed senators on the boat attacks, but they EXCLUDED THE DEMOCRATS.

The Supreme Courtโ€™s order, issued for the full court, did not rule on the Justice Departmentโ€™s October 17 requests for an โ€œimmediateโ€ administrative stay or for a stay pending appeal of U.S. District Judge April Perryโ€™s temporary restraining order blocking deployment of National Guard troops in Illinois.

Instead, the court called for additional briefing about the meaning of two words โ€” โ€œregular forcesโ€ โ€” in the law Trump is relying upon to federalize and deploy the National Guard.

While that legal issue gets complicated, the big news here is that the court has essentially said that it is not planning to issue an order responding to DOJโ€™s โ€œemergencyโ€ request for at least a full month after DOJ filed the request.

Although it is not a ruling, it is, by implication, a pretty clear statement that there is not a majority of the court ready and willing to side with Trump on this issue at this time.

First, the court has not granted DOJ the โ€œimmediateโ€ administrative stay of the TRO that it sought. Although the court has not, technically, denied the request, itโ€™s not going to happen. Further, it took more than a week since the matter was fully briefed on October 21 to get Wednesdayโ€™s order โ€” seeking more briefing. And, when the court did so, it set a relatively relaxed timeline, ordering supplemental briefing by November 10, with time for replies by November 17.
