I think they just admitted, in court, that ICE is out of the DOJ's control.
To paraphrase, if Garcia is released, he will most likely end up in ICE custody again, and it'll cause irreparable harm to the prosecutors.

This is the latest on the shootings in Minnesota of two lawmakers and their spouses. The Governor just spoke and the news is absolutely heartbreaking that Rep. Hortman and her husband are dead and Sen. Hoffman and his wife are fighting for their lives. Shooter is at large and had a manifesto.
