At a college bowl tourney back in the day, I laughed when they told us answers had to be in English. Then later I answered a question about Proust “à la recherche du temps perdu” because I only knew it from Monty Python. Had to quickly translate in my head when the moderator wouldn’t accept it.

Plaintiff lleged he suffered severe physical and
emotional injuries as a result of unknowingly consuming excessively spicy salsa at Los Tacos No. 1's Times Square location. The court granted summary judgment to Los Tacos, concluding that plaintiff's claims failed as a matter of law. First, the court found that plaintiff failed to state a claim that Los Tacos negligently served excessively spicy salsa at the Times Square location, agreeing with the restaurant's argument that Mexican food, and more specifically, salsa, is often spicy. Further, the court held that where there is evidence that the Los

Tacos salsa bar was abnormally spicy as compared
to other salsas or Mexican food, there is no duty to warn a consumer of the spice-associated risks that come with consuming salsa. The court noted that the only evidence plaintiff put forward was his personal testimony regarding injuries suffered from consuming the salsa without providing any evidence of anyone else having suffered an injury form or complained about consuming Los Tacos' salsa. As a result, no jury could conclude that Los Tacos had a duty to warn plaintiff of the inherent spice present in their salsa.

This has become a real issue with mediation. I’ve had three cases in the past six months where the plaintiff has come back and tried to repudiate the signed agreement based on AI feedback.

I am still working on strategies to handle this inside of mediation.
