Under traditional international law, only states were held responsible for breaches. The charter upended that view by holding individuals responsible, preventing defendants from claiming sovereign immunity. The plea of acting under superior orders was left for the judges to decide. /end

Today in history, 1945: The U.S., the U.K., France and the Soviet Union sign the London Charter, establishing laws and procedures for the Nuremberg trials. The charter stipulated the offenses to be prosecuted: war crimes, crimes against peace and crimes against humanity. /1

“Crimes against peace,” as defined in the charter, involved the planning, preparation, initiation or waging of a war of aggression, or a war in violation of international treaties, agreements or assurances. Germany’s invasion of Austria and annexation of the Sudetenland were aggressive acts. /4

War crimes already existed in international law as criminal violations of the laws and customs of war, but these didn’t apply to a government’s treatment of its own citizens. The charter created “crimes against humanity” to encompass “inhumane acts committed against any civilian population.” /2
