They were hoping they could drop it quietly and when it didn't, they felt they had to keep going because, doing something reasonable is woke, or some such non-sense?

This. I consider myself fairly moderate (hell, until 2016, I was a registered Republican). But if progressives are more liable to take on Trump and the creeping/speeding fascism of his administration, then I would rather vote for them.

well, the issue I've seen so far is, did the majority opinion state that the fed needed to refund importers for the costs of these tariffs? I think that's the point that Kavanaugh was getting at. And that by not stating that, it left open the possibility that the Fed would just keep the money.

But yes, for most smaller companies, they've either been passing the import duties on or have been riding the pre-tariff buying spree.

depends on the company, I would imagine. but for companies like Amazon and Walmart, they are. Apple bent the knee and got exemptions (which just goes to show that compliance in advance just makes you look awful and stupid).

Because while he did make a good point, he could have done it as part of a concurring opinion that points out this major issue with the majority opinion.

Sigh, they didn't require the tariffs be refunded. Oh boy, okay, I actually agree with Kavanaugh on something...
So, this is a big deal because most companies have been eating the cost of the tariffs up to now, banking that they would get refunded after this decision...

The ultraviolet aurorae on Ganymede, based on Juno’s close-up observations from 7th July 2021. As Juno flew by Ganymede at high speed, its UV spectrograph could only acquire narrow strips, combined here to display the overall shape of the aurora Image: NASA/JPL-Caltech/SwRI/UVS/ULiège/Gusbin/Bonfond
