Article 8 (2) (b) (xii)
War crime of denying quarter
Elements
1. The perpetrator declared or ordered that there shall be no survivors.
2. Such declaration or order was given in order to threaten an adversary or to conduct hostilities on the basis
that there shall be no survivors.
3. The perpetrator was in a position of effective command or control over the subordinate forces to which the
declaration or order was directed.
4. The conduct took place in the context of and was associated with an international armed conflict.
5. The perpetrator was aware of factual circumstances that established the existence of an armed conflict.

And the elements of the war crime of denial of quarter from the Rome Statute which the USG regarded to be generally consistent with customary international law and which would likely inform interpretation of the offense under the US War Crimes Act.

Every war involves killing. Any war means. death, and pain,
and grief. For centuries the civilized nations of the world have
attempted to reduce the death and suffering by observing the laws
and usages of war. By international conventions and agreements,
such as the Hague and Geneva Conventions, and by general custom, certain practices are internationally regarded as cruel, inhumane, and criminal. Such barbarities include the killing of s,urrendered belligerents, the refusal of quarter, and torture or other
ill-treatment of belligerents or inhabitants of occupied countries.
Such acts are crimes and, if they result in death, are murders.

From the "High Command Case" at Nuremberg:

(1) The accused declared, ordered, or otherwise indicated that there shall be no survivors
or surrender accepted;
(2) The accused thereby intended to threaten an adversary or to conduct hostilities such
that there would be no survivors or surrender accepted;
(3) It was foreseeable that circumstances would be such that a practicable and reasonable
ability to accept surrender would exist;
(4) The accused was in a position of effective command or control over the subordinate
forces to which the declaration or order was directed; and
(5) The conduct took place in the context of and was associated with hostilities.

Apropos of SecDef's remarks this morning:

Denial of quarter—even the declaration of no quarter—is a war crime.

And recognized as such by the US Government.

From DoD's Manual for Military Commissions.

Trump talks about men dying & “walking around with no legs, no arms” and this man holds the nuclear codes!

Meanwhile, PM Mark Carney reminds us that Canada won’t support the carnage of war & that diplomacy, caution & humanity still matter!

How much more evidence do we need? The ultra-rich and the governments supporting them will destroy everything for the sake of profit, power and pride. Nothing is precious to them - not human life, not the living world - except their own wealth and status. Our survival depends on resisting them.

Time, the evil genius, in ‘Forgottenness’ by Tanja Maljartschuk Tanja Maljartschuk, Ukrainian literature, East European novel, Ukrainian novel, Ukrainian culture, English translation

On Women's Day, I'd like to recommend a novel by Tanya Malyartchuk. Forgottenness follows a historian whose life recounts Ukraine's resistance to Russian imperialism. Malyartchuk's narrative, written from the perspective of an aspiring female writer, is imbued with angry melancholy and wry humor.

‘A very dangerous person’: alarm as Pete Hegseth revels in carnage of Iran war Critics say brash, bombastic Fox News host out of his depth to guide US military through murky new Middle East conflict Brash and bellicose, he sounded more like a cartoon bully than a sombre statesman. “Death and destruction from the sky all day long,” Pete Hegseth, wearing a red, white and and blue tie and pocket square, bragged to reporters at the Pentagon near Washington. “This was never meant to be a fair fight, and it is not a fair fight. We are punching them while they’re down, which is exactly how it should be.” Hegseth, 45, a former Fox News TV host who now commands the world’s most powerful military, has this week become the face of Donald Trump’s war in Iran. That has set off for alarm bells for critics who warn that the Secretary of Defense – pointedly rebranded “Secretary of War” – has rapidly transformed the Pentagon into the staging ground for an ideological and religious crusade.
