It is a devolved parliament of Westminster which is why it doesn't even have the authority to ask the people a question in a referendum on a non devolved matter like "the union"

The UK Supreme Court said Holyrood could not trigger a referendum on independence.
BUT -
They didn't say, the people couldn't trigger independence in an election.
The UKSC were mindful that Law follows democracy.
Law doesn't constrain democracy
