... although it is really difficult to tell whether – given the impossible circumstances – MS and MEPs are not actually hiding behind the commission in order not to be blamed should things go South. Commission cannot ratify & implement this deal alone – checks & balances are still there.

not sure I agree that this is an example in which the EU is making European states weaker in trade negotiations… there are substantial disagreements between the parties as it seems now - but the European view of this „deal“ is much more than I expect Switzerland to achieve…

If the current crisis creates the required incentive to finally negotiate modern multilateral trade-rules – we would all win.

For the Swiss journal Die Volkswirtschaft / La Vie économique, I wrote a short piece on the basics of tariff-rules, lost consensus, and opportunity of re-negotiation.

But the US have a valid point: the current system does not provide the instruments necessary to adequately address state capitalism, industrial policy and economic dependencies, let alone the protection of climate and human rights.

The news from across the pond are heart-wrenching and I can't agree with blaming the multilateral system for the US trade deficit: deficit is limited to goods (surplus in services), result of domestic policy and US remain the largest market in the world (hence multilateralism not that unfair).

I've been digesting the court ruling and here are the implications for Europe. The 'reciprocal' tariffs are out, so no more 10 per cent general tariff for all countries. Sectoral tariffs on autos and steel/aluminum still in place so this doesn't affect the US-UK 'deal'. For the EU though..1/x

fantastic - that is exactly what we are also pointing out in our edited volume on sustainable development in Swiss law - and what I argue in my habilitation. Generational equity is far more precise in its normative scope than is generally known and accepted.

If congress decided the tariffs, that would be in line with constitution - that’s my take-away. Hence the question whether congress will face increasing pressure to sign Trump-tariffs into law…?

… it seems to be a death blow though to tariffs based on executive orders alone, not? I am not surprised by the decision; would be very surprised if in appeal decision is revoked. So: pressuring congress into signing the tariffs off?

if we‘re talking about our country (Switzerland), then the president actually has no power whatsoever to execute anything without majority vote in the federal council (and proper authorization in federal or constitutional law).

My take on today's US court tariff ruling. This is an excellent opportunity for the EU and other trading partners to quit preparing packages of concessions, tell Trump to shove it and get on with trading without the US.
