There's a big difference between saying "It's illegal" and saying "It's not going to happen because it's illegal," the latter of which is what I find naive and argue against.
While I agree with you, way too many make these "it's illegal" posts as a way to tell people to stop being upset because, as they seem to think, it won't happen because it's illegal. So it's not a binary. One can acknowledge that it's illegal, and say that it's entirely possible.

People keep saying that, but if the legislative branch and the judicial branch do fuck all to stop him, it doesn't matter if it's illegal. The people in charge of making the laws and interpreting the laws are not doing their job, and he runs the branch that's supposed to enforce the laws.
Well, certainly when the "checks and balances" are gone. Theoretically the legislative and judicial branches could at least slow him down, but we'll never know, because they're not even raising a finger to do so.
