3. Il résulte de l'instruction qu'alors que le recours de M. A... contre la décision de l'Office français de protection des réfugiés et apatrides rejetant sa demande d'asile avait été enregistré, ainsi qu'il a été dit au point 1, le 20 avril 2018, la décision le concernant n'a été rendue par la Cour nationale du droit d'asile que le 26 juillet 2021. La durée de la procédure juridictionnelle devant la Cour a ainsi atteint trois ans trois mois et six jours. Malgré la complexité de l'affaire en cause, un tel délai a revêtu en l'espèce, au regard tant de l'objet du litige que de la situation particulière du requérant, placé sous écrou extraditionnel, un caractère excessif. M. A... est, par suite, fondé à soutenir que son droit à ce que sa cause soit entendue dans un délai raisonnable a été méconnu et que la responsabilité de l'Etat doit être engagée pour ce motif. (...) 6. M. A... recherche la responsabilité de l'Etat à raison de l'illégalité alléguée du refus de la préfète de la région Grand Est, préfète du Bas Rhin de requérir son extraction pour lui permettre de comparaître en personne à l'audience du 5 juillet 2021 devant la Cour nationale du droit d'asile, au cours de laquelle son recours contre la décision de l'Office français de protection des réfugiés et apatrides lui refusant l'asile a été examiné. Il soutient que le défaut de comparution en résultant l'a empêché d'être entendu par la Cour, le privant ainsi d'une chance sérieuse d'obtenir une protection internationale, ce qui lui aurait causé différents préjudices. Toutefois, une telle argumentation revient à remettre en cause les conditions dans lesquelles la Cour nationale du droit d'asile s'est prononcée sur son recours, notamment les motifs de sa décision du 26 juillet 2021, devenue irrévocable, par lesquels elle a refusé de faire droit à la demande présentée au nom de M. A... de renvoi de l'affaire à une audience ultérieure et a rejeté son recours. (...)
