My favorite part of E.T. is the part where the mom comes walking out of the closet.

Intelligence is knowing that Scrooge meets four ghosts in A Christmas Carol.

Wisdom is knowing that he meets five ghosts.

Freakier Friday is probably better than the original.

Weapons may have a perfect ending.

June Diane Raphael was in both.

This is the summer double-bill.

75% participation rate on the Isle Delfino is actually pretty good. US is at around 62%.

@anyaustin.bsky.social Rewatching some of your videos, and I think you’re using β€œunemployment rate” when you mean β€œlabor force participation rate.”

And then Teneille never took his last name. Could you imagine?

I guess it made less paperwork during the divorce.

What a gift that wouldn’t exist if you knew he was called Dragon from the start.

To be clear, I think this ruling was wrong and boneheaded for all the reasons noted in the dissent. But until Congress or the States fix the SCOTUS problem, we have to pretend that its rules matter.

08.04.2025 23:26 β€” πŸ‘ 0    πŸ” 0    πŸ’¬ 1    πŸ“Œ 0

I’m a lawyer. Those are distinctions with a clear difference.

It *may* be true that the difference may not matter for the plaintiffs who filed the case because it’s now too late to do anything about it, but going forward, attorneys will know not to abandon habeas claims after filing.

08.04.2025 23:18 β€” πŸ‘ 0    πŸ” 0    πŸ’¬ 1    πŸ“Œ 0

Basically.

An old standby of SCOTUS is if it can’t justify what it wants to do on merits, it justifies it via procedure.

08.04.2025 22:53 β€” πŸ‘ 3    πŸ” 0    πŸ’¬ 1    πŸ“Œ 0

In the original petitions, they filed habeas petitions as one cause of action. They abandoned that claim at some point during the case.

Defendants walked into a pizza place and ordered a hamburger (they challenged the order under the Administrative Procedures Act instead of by habeas). β€œSir, this is a pizza place. If you want a hamburger, you have to go to a hamburger place.”

Basically, they didn’t file the right kind of claim.

08.04.2025 22:14 β€” πŸ‘ 0    πŸ” 0    πŸ’¬ 0    πŸ“Œ 0

That’s not what it said. It said, β€œThe way to do this is through habeas, not the Administrative Procedures Act.”
