I think the goal of the argument is to avoid Section 1 entirely. That is, there is not even a Section 2(d) breach as long as neutral arbitration is substituted.

Seems to me that is a very surprising read of SFL.

If that argument were accepted by courts then SFL would have the bizarre effect of abolishing the right to strike, since govts could just legislate arbitration whenever it suits them (ie whenever a strike would be effective).

I’m noticing a trend in employer/employer counsel arguments about scope of constitutional right to strike in Canada.

Their argument is that the SCC didn’t actually recognize a β€œright to strike” in the SFL case.

Instead it recognized a right to neutral arbitration. Thus, govt’s can just impose arb.

A worker who does real work (work that needs to be done) for a not-for-profit MAY also be an "employee", but that requires a more nuanced analysis. We want people to volunteer for charities.

But it's more straightforward for for-profit businesses.

Real Work + For-Profit Business = NOT Volunteer.
