What you’re talking about is called sectoral bargaining. Conceptually, it’s highly necessary and a great idea. But the devil is always in the details. Who does the bargaining and who enforces the agreements as soon as the bosses violate? You can’t have a sellout negotiate or weak enforcement…

That’s the cemex case. There was a strike action and cement dried in trucks, causing damage. The employer was allowed to recover losses because the NLRB determined there was no effort made to mitigate the damage. It was a bad ruling but not about profits due.
