3 thoughts come to mind. 1. They aren't actually sending it out for another review, but the AE or Ed Asst didn't modify the letter to reflect that. 2. The journal has a policy to have x number of reviews. 3. The AE doesn't have expertise to evaluate whether you addressed a specific issue.

Unfortunately, federal law does not protect against discrim on the basis of gender identity, which makes it very different from reintroducing racial segregation (which is federally protected). I was an HR professor for 20+ years and have testified on ~40 discrim cases.
