The DOJ’s criminal investigation of Fed Chair Jerome Powell has rightly produced enormous outcry in the central banking community, in the economics profession and, thankfully, among members of Congress. What the Trump Administration has underestimated is the possible outcome associated with their actions: (1) The likelihood that Powell would choose to remain as a Governor after his term as Chair expires in May is now undoubtedly higher; (2) The Senate Banking Committee may place a high hurdle on sending the next nominee for Fed Chair to the Senate floor for confirmation, delaying the appointment; (3) The FOMC elects its Chair by convention in the first FOMC meeting of a calendar year. The FOMC Chair is not given to the Board Chair by statute, although that’s the person who has historically been elected. Thus, even after Powell’s term as Board Chair ends in May, he could still serve as Chair of the FOMC because they are separate positions.
