after the remove-all-tarps provision. Order Ex. A, Idx. 21, at ¶¶ 7, 10. Both Defendant and Counsel
for Plaintiff suggested this deadline was to allow more time to remove the addition because of
potential weather conditions. And the remove-all-tarps provision refers to multiple breaching tarps
on the Lot, while the remove-the-addition provision refers to a single object. The remove-all-tarps
provision is thus a more specific provision of the Settlement Agreement which carves out the
addition (and thus the tarp integrated into it) from the more general provision to “remove all tarps.”
Thus, the tarp on the addition, as a part of the addition as whole, is governed by the May 15
deadline of the remove-the-addition provision.
The Court is within its discretion to take judicial notice of the date. Hesse v. Hesse, 778
N.W.2d 98, 103 (Minn. Ct. App. 2009) (“A court may take judicial notice of the course of the
calendar.”). It is not yet May 15, 2026. Because Defendant has until May 15 to remove the addition
and the tarp integrated into it, he is not in breach of the Settlement Agreement.

Unambiguous language in a contract “must be given its plain and ordinary meaning.” Denelsbeck, 666 N.W.2d at 346 (quotation omitted). Tarps are tarps. Roof underlayment is not a tarp. The Settlement Agreement makes no mention of roof underlayment, but does require tarps to be removed from the Lot by January 15, 2026. Order Ex. A, Idx. 21, at ¶ 10. The Court may not expand this requirement to include an entirely different type of material integrated into the construction of the shed, particularly when Defendant has until May 15, 2026, to “remove the shed.” Id. at ¶ 7. Because there is no tarp on the roof of the shed, Defendant is not in breach of the Settlement Agreement.

Respectfully, eat shit. Those kids were expelled, arrested, and targeted relentlessly by their school administrations with the specific goal of preventing further protest. Eighteen year old kids were held down and maced by campus security, hit point blank with tear gas canisters by riot cops.
