To answer my own question ... I see from the FAQ authorsguild.org/advocacy/art... that the default split between authors and publishers will be 50:50, unless the author or publisher can produce a contract that stipulates a different split.

How can even US authors file a claim? Surely the rights to the vast majority of books and articles are owned by publishers not authors.
