What is also interesting is that at [55] of the judgment it becomes clear that this was not an isolated incident by the barrister in question.... I wonder how, if at all, this will impact the referral to regulators.

Agree completely — not just enough to assert substitution (or significant substitution) but to prove perfect (or virtually perfect) substitution, which is a very high burden. Also, very clear summary on downstream emissions and MSA in the case at [187] by Holgate J (as he then was).
