How do you fairly communicate to people “you ought to assert this, both because if they ignore it it reflects on them and because they may not ignore it, but also totally yeah they may ignore it”? That’s a mess. It’s wholly unactionable. But it’s what we got.
This is a truly, truly hard question that I talk about in private a LOT and in public very little _because_ it’s so important and so tricky.
On the one hand people should know what their rights are.
On the other the state may not recognize them if asserted.

We’re in such a dangerous moment because Trump can talk himself into any belief necessary to justify pressing any button, but cannot solve the problem in front of him, which is far too complex for his delusional, childlike mind. So there’s a possibility he’ll eventually mash ALL the buttons.
This is why, among other things, I think the prospect of nuclear escalation is very real. He can more readily manifest for himself and the people around him some set of facts showing greater brute force is needed than navigate a careful path back out of the literal minefield he blundered into.
And this is a huge issue for the whole world because this is TRUMP’S ONLY TACTIC. He can’t solve anything, can’t understand anything, can’t out-negotiate anyone. He has no capacity to end a war. He will just keep making increasingly delusional pronouncements in an attempt to manifest reality.
It turns out you can make people see many things that do not exist at all - scary things, good things. You can claim that you have absolute power as president and many courts will agree rather than challenge you.
You cannot, however, declare a seaway safe and have it become so!
Trump’s power and by extension his entire movement are built around the idea that by asserting something you manifest it in reality. Even if it’s not true many people will behave as if is so you can get away with it.
It is alarmingly effective in law, domestic politics. It cannot unblock a strait.
