The Fed won a sweeping court victory Friday. But the fact that it needed one tells you everything about how much has changed.
The unsealed filings are something else—the Fed catalogued 100 Trump attacks on Powell.
Fed independence used to be protected by norms. Now it’s depending on judges.
On deeper reflection, one thing I love about this once-secret motion to quash subpoenas is that the Fed retained private counsel to fight an illegitimate use of U.S. government power.

Sitting presidents cannot be indicted while in office.
Implication: DOJ can investigate, gather evidence, and prepare cases, but cannot file charges until the president leaves office.
Reality: President is temporarily insulated from criminal accountability.
This was always going to happen: Trump, and the Supreme Court, turned DOJ into an extension of the president's will. Now, judges trust DOJ about as far as they can throw it.
The immunity decision and unitary executive theory breed corruption and ineffectiveness.
