European Commission President von der Leyen seems to have changed her opinion on using article 122 of the EU treaty TFEU within the past four months. That article is an emergency instrument which allows the Commission to take action with the member states but without the European Parliament.

De rechter deed vandaag een snoeiharde uitspraak over de blokkade die minister Wiersma oplegt bij het openbaar maken van een database waarin de aantallen dieren op boerderijen staan. Volgens de rechter ‘misbruikt’ de minister haar bevoegdheden en probeert ze de procedure doelbewust te vertragen.

The European Commission made me wait more than a year for two documents related to a roundtable on the Recovery and Resilience Facility. The deadline to reply is 15 working days. I had to wait 313 working days since my initial request (and 266 since appealing). www.asktheeu.org/request/rrf_...

Among the documents was also an email dated three days after Michalik had announced his new job, in which ESMA informed him it restricted his access to confidential information.

Michalik disagreed with the restrictive measures, saying "the conditions set out in the recommendations are disproportionately strict".

His objections were "duly noted", but in the end ESMA decided a lobby ban was still justified, "to prevent any perception of a potential conflict of interest".

The ethics officer said there was no *actual* conflict of interest in the ESMA staff member joining Euronext, but that there could arise a *potential* conflict of interest. And to mitigate that, the ethics officer proposed a lobbying ban for six months.

A former senior employee of the European Securities and Markets Authority, Jakub Michalik, left to join Euronext.

According to a document released at my request, ESMA's ethics officer noted Euronext "operates in various fields overlapping with ESMA’s trading and post-trading mandates".

EU institutions have been accused of not doing enough to prevent conflicts of interests re: the "revolving door" phenomena.

But I now found an example of what seems like a thorough assessment of conflicts of interest, and an imposed lobbying ban despite objections from the former staff member.
