Judge: It doesn't sound like mediation or settlement talks make sense at this point. Anything else?
Seigel: We'd like 21 days to oppose his motion to dismiss.
Blackburn: Fine with me. I oppose the motions for sanctions, I have that ready to go

Judge Rochon: I was put off the IPTC [Initial Pre Trial Conference] in the second action until service is made. I have ROC Nation's motion to dismiss but we don't have everyone at the table. I set the IPTC for Oct 14 at 10 am.
Seigel: Fine.

Judge Rochon: These claims are not sufficiently related. So I deny the request to dismiss or stay the second action. But I mark them as related under SDNY Rule 13(a)(1) and consolidate them so they move along the same track. But the 2d is not ready for discovery

Judge Rochon: I will deny the request by Cartagena [Fat Joe] for dismissal of the second case - it involves different claims. The overlap on the claim of extortion and retaliation. But the claim of racketeers is not subsumed in the later defamation case.

Judge: I'll rule on that. The 2d Circuit has explained that the transaction or occurrence test is met in this situation- judicial economic dictates. These are compulsory counterclaims, Cartagena argues in Dkt 26. Dixon opposes, alleging at pattern from 2008 to now

Blackburn: I am willing to consolidate, I have no problem with that
Judge: Would you dismiss your case and refile it as a counterclaim?
Blackburn: No. The first action should just be dismissed. I guess what the court is saying is you want to go through the process

Judge: What about consolidating the two days?
Seigel: They are related - Mr. Blackburn's case should just be a counterclaim in ours. That is our request.
Blackburn: I oppose that - their action is baseless and I move[d?] to dismiss

Seigel: Where we wrote 2025 we meant 2026
Judge: I'll make those changes. I'll set a post discovery conference for Feb 17 at 10 am - by then you'll let me know if you are moving for summary judgment. In the interim I'll consider any motions to dismiss.

Blackburn: A lawyer has a right to advocate. I will file my motion by the end of the day.
Judge Rochon: Thank you. I won't grant you a stay of discovery - it will go forward. I will enter the case management plan and its discovery schedule.

Blackburn: The first action was amended on July 21, so I'm well within my time to move to dismiss. They cite things my client said in 2023, it's outside the statute of limitations.
