What does the TM mean?
It doesn't necessarily mean the thing it's appended to is functions as a trademark.
It doesn't mean the thing has been registered (that's an R).
Mightn't it be fair to say TM is largely aspirational?
A statement that "we'd like you to see this as a trademark"?
the christophers were hired by a secret client whose identity wasn't disclosed until after the case was remanded
the initial complaint mostly sought to find out WHO was taking pics
the photog who took the photos took 2 sets. the 1st was blurry, so he returned a 2nd day. this is significant b/c dupont didn't notice the first day or didn't care, but the 2nd day they got upset.
dupont might've been used to getting "buzzed," but the return was suspicious
