In the short time since Kavanaugh wrote that opinion, his assertions have been proved demonstrably, almost laughably false too many times to count. As Sherrilyn Ifill notes, the justice’s claims were already belied by the factual record in that case, which showed ICE agents violently harassing and detaining American citizens for extended periods simply because they are Latino. Now the agency, freed from constitutional restraints by SCOTUS, has stopped pretending to be engaged in anything other than racial profiling. Bovino’s admission only confirms what we already knew: These detentions, far from the “brief” inconvenience Kavanaugh described, are often lengthy, violent, and dangerous. Ifill and Anil Kalhan, a professor of law at Drexel University, have proposed calling these detainments “Kavanaugh stops,” a label that’s quickly catching on.

S. citizens; one was then pushed against a fence with his arms twisted behind his back, and the other was taken away from his job to a warehouse for further questioning. More fundamentally, it is the Government’s burden to prove that it has reasonable suspicion to stop someone. The concurrence improperly shifts the burden onto an entire class of citizens to carry enough documentation to prove that they deserve to walk freely. The Constitution does not permit the creation of such a second-class citizenship status.

Justice Sotomayor, not mincing words, also says that today's decision will lead to the "creation of [] a second-class citizenship status" for Latinos, who now will have the burden to "carry enough documentation to prove that they deserve to walk freely."

To put this into context, the judicial warrant for the search at the Hyundai plant named just four people.

Relying on that warrant, ICE detained nearly 500 people. DHS admitted that included U.S. citizens, permanent residents, and people lawfully here on visas.

This is an actual exchange from a VP who took an oath to defend the constitution and, as a citizen, is expected to abide by the law.
