Legal academics have a right to critique. But when that critique relies on erasing 260 years of history to frame the Constitution as a 'threat,' it becomes something else completely.
To be clear, Section 35 does not create the right. It affirms rights that already existed. Just look at Section 25.
There is something concerning about a lawyer and professor calling Aboriginal title - a constitutional obligation, a threat.
At some point we should expect some measure of truth from those licensed to practice law and teach law. How else can there be any faith in the legal system?

There is a kind of irony in Ford using a private legal team to argue that his personal phone shouldn't be searched because it's irrelevant to his job, while simultaneously claiming the search would take so much time it would "sideline" him from doing that very job. The Court called his bluff.
