It is my position that when posting content, the content should conform to the relevant laws.

If posting to YouTube specifically, it should additionally conform to YT's requirements, including whether to check the paid promotion checkbox.

I don't think that's a hardship.

Fair enough. The language in YT Help is terrible, and most see what they want to see in it.

Legally "a thing of value" is anything of value. If she could have made the same video for the same cost at the same time without accepting the loan, THEN it's not a thing of value. Obviously, it had value.

She satisfied the FTC requirements... All she did was fail to follow YT rule to check the box. Not sure if YT ever enforces it.

FTC has threatened some influencers over failure to disclose ($50k)... But they usually only go after the companies posting fake vids ($Ms)

A loan is a thing of value in all US legal contexts I am aware of. When a company loans gear, that gear is taken as a loss on their taxes; in this case a marketing expense.

I understand that it is perceived differently than a gift, but it's still a thing of value provided for marketing.

It's different "conceptually", yes...

...just not to YouTube nor to the FTC. The FTC extends disclosure to other products you mention from the company who gave you something of value, even if you weren't asked to mention that product.

Fun Fact: These rules don't apply to broadcast media.

Yes. They should all click the "Paid Promotion" checkbox in YouTube Studio for exactly that reason.

If you went to a dealership and used a test drive to shoot a video... that's not a paid promotion. The company had nothing to do with it, and didn't provide anything that isn't available to everyone

Paid promotion

Ok, so I don't mislead anyone reading this later: Under YouTube's TOS... This would be called a "paid promotion", not a sponsorship. So the correct thing to do is use the "paid promotion" banner and state that it is a "paid promotion".

I'm interested in the X5 because I often do interior stuff... And usually have to knock it down to 5K to prevent smearing... And even then it's just okay. If This makes a difference, it will have been worth it.

Yes, I agree that this has been normalized to the audience. But last I recall, both legally and according to YouTube TOS... It is sponsored.

A few YouTubers religiously state that their videos are sponsored, but that it is limited to access to the devices... And that's accurate. Anywho...

I will have the X5 tomorrow, I'll let you know. I skipped the X3; criminally incremental. The X4 was worth it over the X2.

YouTubers need credibility, so I get the temptation... but early access and a device are things of value. It's ok to say it's sponsored and then detail the nature of it.
